A.R.S.23-403.A:  The employer did not furnish to each of his employees
employment and a
place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to their employees, in that the
employer did not ensure
that restraining devices (i.e. seat belts were installed on each forklift
to restrain the operator
in the event of a rollover.  Both the ANSI B561-1993 (Standard for powered
industrial
trucks) and ASME B56.1-2000 consensus standard (Revision of ASME
B56.1-1993) Safety
Standard for Low Lift and High Lift Trucks, recognize the hazard of
forklift rollover and the
need for operators to use an operator restraint system, such as the seat
belt.
