Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to equipment roll over:
On 10/3/08 at and around the 2300 Block of State Route 15, employees were
exposed to the
hazard of equipment roll over when operating an Ingersoll Rand MN DD-16;
SN 194862
vibratory roller due to the seat belt not being facilitated, among other
methods, one feasible
and acceptable abatement method to correct this hazardous condition would
be to wear the
seatbelt as described in the Ingersoll Rand Safety Label Manual for
Vibratory Compactors
Models DD-14, DD-16 Dura Pack.
Abatement documentation is required for this item in accordance with the
requirements of 29
CFR 1903.19(d).
