Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an approximately 200 pound light pole being lifted by an aerial lift. Parking lot, next to entry to State Route 159- On January 22, 2008, an employee was using a Genie, model number S-60 articulating boom lift, serial number S608884, as a crane to lift an approximately 200 pound 17 foot metal light pole, which exposed the employees under the lift and pole and/or lift itself; this action was against manufacturers' recommendations (p.4 "Do not place or attach overhanging loads to any part of the machine"); according to consensus standards ANSI A92.5, 1980. Section 13.2.1. the work platform shall be used in accordance with the manufacturers'/owners operating instructions and safety rules. Among other methods, one feasible and acceptable method to abate this hazard is for the employer to use a crane to lift the post into place. ABATEMENT DOCUMENTATION IS REQUIRED FOR THE ITEM IN ACCORDANCE WITH THE REQUIREMENTS OF 29 CFR 1903(d).
