Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to struck-by/caught-between hazards and related crush injuries from machinery/equipment that was not equipped with ROPS/Seat-Belts and was operated in and around terrain which could potentially cause rollover accidents:: A.) Marsh Planing - Allison Chalmers Backhoe: Employees utilized the back-hoe for maneuvering scrap and for digging footers for the future garage building. The backhoe was not equipped with a seat-belt and ROPS. The site contained terrain that was conducive to rollover accidents (e.g. gravel pit, hillsides, drop-offs). ABATEMENT NOTE: Among other methods, feasible and acceptable means of abatement include: 1. Equipping the Back-hoe with a seat-belt and ROPS. OR 2. Instituting administrative measures to ensure company personnel and employees can not utilize the back-hoe.
