employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck-by an excavator:
a) Worksite located at 43rd St. & West Side Ave., North Bergen, NJ
a) Employee was within the swing radius of a CAT 330CL excavator while
climbing on
a rail car container.
Violation was observed on 11/10/05
AMONG OTHER METHODS, ONE FEASIBLE MEANS OF ABATEMENT IS TO:
1) Do not allow employees to enter the alleyway area when operating the
excavator.
