North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees, in that employees were exposed to falls in excess of 10 feet
from a platform on the forks of the lift
truck:
a)jobsite-    the employee was working installing wall sheeting from a
wooden platform designed
to lift material on the forks of the Lull Model 644B-42 extendable fork
lift truck without the
protection of guardrails at 10 feet above the compacted ground below.

One reasonable and acceptable method of abatement would be to provide
guardrails to prevent employees from
falling from the platform.
