North Carolina General Statue 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment
and a place of employment which were free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to:
a)being crushed or caught between, in the event of an upset of the order
picker
lift truck. The employees operating the BT Prime Mover order picker lift
truck, Model #DF15C, Serial #CF15C257062, was not provided with a
safetybelt on and prior to 8/3/06, as required by the warning label and
owners
manual.
Among others, one feasible and acceptable abatement method would be to
provide a safetybelt in the order picker lift truck and require the
employees to
use them while operating the forklifts.
