Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of explosion and/or fire: a.Dust Collection System: Employees were exposed to the hazard of fire and/or explosion resulting from the ignition of the contents of the dust collection system because the system, as installed, was not equipped with a spark detection system, as referenced in NFPA 664 8.2.2.6.2. The company also had not established a documented inspection, testing and maintenance program for the dust collection system, as referenced in NFPA 664 10.2.1 and 10.2.2, nor had it retained required records relating to its dust collection system, as referenced in NFPA 664 10.2 and 10.3. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to comply with the guidelines outlined in the National Fire Protection Association (NFPA) 664 Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities (2007 Edition). VERIFICATION REQUIRED
