Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that employees were
exposed to fall hazards associated with manually propelled elevating
platform lifts.
Location - 28 State Street, Boston:
On 04/01/06, an operator of the aerial platform was positioned on the
guarded platform
and elevated approximately 28 feet without all outriggers engaged when the
lift
overturned and fell to the brick concourse as his supervisor attempted to
move/pull it
along the tall glass entryway to the building of which they were cleaning.
The method or methods to feasibly correct or abate the hazards include,
but are not
limited to, the following elements:
1. Ensure that the operator performs a workplace inspection to assess
possible hazards such as
floor or surface obstructions for locating and positioning the lift.
2. Ensure that operators engage all outriggers, stabilizers, and level the
aerial platform with
leveling legs as required by the manufacturer before operating the lift.
3. Ensure that operators fully lower the aerial platform to the full down
position before
relocating the lift.
4. Ensure all employees follow manufacturers' warnings users
responsibilities outlined in
ANSI/SIA A92.3-1990 for operating and assisting with manually propelled
elevating aerial
platforms.
5. Ensure that a copy of the operating and maintenance manual from the
manufacturer is kept
on the aerial platform for operators to consult when questions arise with
respect to the aerial
platform.
