Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling down an elevator shaft due to a hoistway door interlock and door locking device not functioning properly: Location: 34 State Street Ossining NY On or about 4/14/06, a) The interlock and magnetic door locking device for the hoistway door on the second floor weren't functioning properly. The door was opened without the elevator car being at the floor. Among other methods, one feasible and acceptable abatement method to correct this hazard is: to ensure that interlocks and door locking devices are functioning properly and follow ASME A 17.3-1996 section 2.7. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling down a flight of stairs, falling down an elevator shaft, walking into fixed objects and walking into equipment due to poor lighting: Location: 34 State Street Ossining NY On or about 4/14/06, a) The second floor lights weren't turned on in the old factory area. There was a freight elevator in the area and a stairway going from the second floor to the floor above and there was old factory equipment in scattered parts of the floor. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. Among other methods, one feasible and acceptable abatement method to correct this hazard is: to provide lighting that conforms to the current recommended illuminance ranges described in ANSI/IES RP-7 Recommended Practice for Lighting Industrial facilities and ANSI RP-1 American National Standard for Office Lighting.
