North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to struck by/crushed by ROPS during tipover:
a)facility, cube #1 - where the operator of the YALE, Model
ERP030TFN36SE078, S/N 701872,
2,000 pound capacity forklift was not wearing the installed seat belt
during operation.
Abatement note: Among other methods, one feasible and acceptable abatement
method to correct this hazard is
to have operators fasten the installed seat belt when operating equipment.
Reference: ASME B56-1-1993, Paragraph 5.3.19:  An active operator
protection device or system, when
provided, shall be used.
