Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employmnent and a place of employment which were
free from recognized hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were exposed to hazards associated with working in confined
spaces, such as sewer manholes
approximately 13 feet deep:
(a) The employer did not develop and implement a written confined space
program for the Plank and Tahoe job site. The employer did not comply with
the requirements of the American National
Standards Institute (ANSI/ASSE) Z117.1-2003: Safety Requirements for
Confined Space, paragraph 3.6 and 3.6.1.
(b) A confined space permit was not completed prior to a worker entering a
Permit Required Confined Space (PRCS) manhole approximately 13 feet deep,
as required by ANSI/ASSE Z117.1-
2003, paragraphs 5.1 through 5.5.
(c) Atmospheric testing was not done prior to a worker entering into a
PRCS manhole approximately 13 feet deep, as required by ANSI/ASSE
Z117.1-2003, paragraphs 6.1 through 6.3.2.2.
(d) Emergency procedures were not in place for PRCS entry including means
of providing timely rescue for employees entering into sewer manholes as
required by ANSI/ASSE Z117.1-2003,
paragraphs 7.1.3.3 and 7.4.1.1(3).
Among other methods, feasible methods of abatement would be to develop and
implement a written confined space program complying with the American
National Standards Institute,
ANSI/ASSE Z117.1-2003; Safety Requirements for Confined Space or the OSHA
General Industry Standards 1910.146.
Abatement Certification and Abatement Documentation required.
