Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an 18 foot fall:
(a) At the site, employees were exposed to multiple injuries and/or death
when working on
building facia climbing and standing on the guard railings on a self
propelled platform 18 feet
above ground level and the midrail was missing at the platform entrance.
The scissor lift was
not used in accordance with the acceptable requirements of the American
National Safety
Standards for Self propelled Work Platforms; ASME/ANSI A92.6 1999, Section
7.10.9:
Personnel shall maintain a firm footing on the platform floor while
working thereon. Climbing
by occupants on the midrail or toprail of the aerial platform is
prohibited and Section 7.10.4:
Guardrails shall be installed and positioned, and access gates or openings
shall
be closed.
Among other methods, feasible and acceptable methods of correcting the
hazard:
Conduct all work standing on the floor of the platform or use a ladder to
access the roof
with conventional fall protection and install a midrail on the platform of
the scissors lift.
