Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to death or serious injuries in that they were exposed to fall hazards while working from a ladder on a scissor lift platform. Self-Propelled Elevating Work Platform as used by the employer did not meet the use requirements of American National Standards Institute ANSI/SIA A92.6-1999 for Self-Propelled Elevating Work Platforms, section 7.8 Work Place Inspection, paragraph (10) which states that before the aerial lift is used and during use, the user shall check the area in which the aerial platforms is to be used for other possible unsafe conditions, and Section 7.10 Operator Warnings and Instructions, paragraph (9) Personnel footing, which states that Personnel shall maintain a firm footing on the platform floor while working thereon. It further states The use of planks, ladders, or any other devices on the platform for achieving additional height or reach is prohibited. (a) On June 11,2008, an employee was working at Menards installing new wiring. The employee was working from a six foot ladder that was on the platform of a scissor lift approximately fifteen feet above ground level. Among other methods, feasible and acceptable means to correct the hazards are to have the employees keep both feet on the floor of the lift. No Abatement Certification or Abatement Documentation required.tion
