Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck by or caught between heavy
equipment vehicles:
a)  Dumping Area - Employees required to work around heavy moving
equipment are
not provided adequate training on procedures to be followed when equipment
is working
in close proximity.  There were no comprehensive safety and health
procedures
implemented covering the spotter's job description.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable abatement
method to correct his hazard is to:
a) Design, develop, and implement a comprehensive written safety and health
program and train all employees in the program elements prior to their
entry into
the landfill.  At a minimum, the landfill specific training program should
include:
- How to recognize hazards.
- How to work safely.
- Knowledge of equipment blind spots.
- Communication methods for personnel on foot and landfill mobile
equipment.
b) Consider using other safety devices for landfill equipment to warn
drivers
when someone is in their blind spot such as:
- video cameras and monitors
- electromagnetic, infrared or ultrasonic detection equipment.
Abatement certification and documentation required within 10 days after
abatement date.
The certification shall include a statement that abatement is complete,
date and method of
abatement, and states employees and their representatives were informed of
this abatement.
Abatement documentation shall  include documents demonstrating that
abatement is
complete, such as evidence of the purchase or repair of equipment,
photographic or video
evidence of abatement or other written records.
