Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling. On or about January 11, 2006 at the work-site located along Hwy 103 north of Green Forest, Arkansas an employee working from a scaffold platform attached to a CAT TH63 rough terrain forklift was exposed to injuries from falls due to not being protected by the use of a personal fall arrest system. One feasible method of abatement, among others is to initiate and require that personal fall arrest systems in accordance with Section 8.8(g) of the American National Standard Institute, Boom Supported Elevating Work Platforms (ANSI A-92.5-1992)
