Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a. Receive serious injuries in that employees were exposed to
verbal,phisical
threats and
harass by customers . The employer did not have a control plan to deal
with workplace
violence incidents. Among other methods one feasible and acceptable
abatement methods
to correct this hazard is, to prepare a control plan of workplace violance
that assess and
address the following:
1. Workplace violence hazards, such as harrass, verbal and physical threat
2. Record and incident investigations of violence at the workplace.
3. Employee training of workplace violance issues.
4. Develop preventive and implement corrective actions, including
counseling services
to affect employees.
a. Recibir serias lesiones en que los empleados estaban expuestos a
amenazas verbales,
fisicas y hostigados por clientes . El patrono no tenia o proveyo un plan
de control para
tratar con incidentes de violencia en el trabajo. Entre otros metodos, un
metodo aceptable
y posible para corregir este riesgo es, preparar un plan de control de
violencia
en el
trabajo que evalue y trate lo siguiente:
1. Riesgos de violencia en el trabajo tales como, hostigamiento, amenazas
verbales y
fisicas.
2. Registro e investigacion de incidentes de violencia en el area de
trabajo
3. Adiestramientos a empleados sobre temas de violencia en el area de
trabajo
4. Desarollar acciones preventivas y correctivas, incluyendo servicios de
consejeria a
empleados afectados.
