Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
a) Getty Gas Station, Belmar, NJ. - An employee was exposed to
struck by hazards while working with an air/electric tire changer
that exploded causing the employee to become hospitalized. The
employer did not provide training to the employee.
b) Getty Gas Station, Belmar, NJ. - An employee was exposed to
struck by hazards while trying to mount a 16" tire onto a 16 1/2"
rim using the air/electric tire changer.
5(a)(1) Documentation
1a) Hazard to which employees were exposed - Struck by
hazards.

2a) Hazard recognition - The employee was not trained to
recognize hazards that would cause physical harm and/or death.
2b) Hazard recognition - The employee did not read the
operators manual prior to using the Air/Electric Tire Changer,
Model EEWH311A, page 6, paragraph 1.
3a) Potential For Death Or Serious Physical Harm - On
06/16/06, while operating the air/electric tire changer to change
a tire, the tire exploded producing hazardous flying debris and
sending the employee to the Jersey Shore Hospital.
3b) Potential For Death Or Serious Physical Harm - On

AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD
TO CORRECT THIS HAZARD WOULD BE TO :

4b)  Require employees to follow instructions of the operators
manual.
