Section 5(a)(1) of the OSHA Act of 1970: The employer did not furnish to
employees
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death of serious physical harm to employees in
that employees were
exposed to being struck by the bucket or boom of an excavator:
a.On or about November 6, 2006, while leaning down to move a loose object
on
the excavator cab floor, the operator inadvetently leaned into the
right-hand
control lever causing the boom and bucket to drop and strike another
employee
who was attempting to connect a load (a vibratory head) to the bucket of
the
excavator.
Feasile and acceptable methods of abatement include keeping riggers clear
of the
elevated bucket and boom of excavator operator's cab, to train the
operators not
to operate the excavator when loose objects are in the opertor's
compartment,
to
train operators to focus on the task during rigging operations, and to
train
operators to engage brakes and/or other mechanisms to prevent the boom from
moving while a load is being rigged to it.
ABATEMENT CERTIFICATION IS NOT REQUIRED.
