Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employee in that
employees were exposed to fall hazards.
a) 601 Route 22 West, Whitehouse Station, NJ 08889. Employee was allowed
to work
in excess of 18 feet above ground level from a job-made basket/platform
that was
sitting on the forks of a 10042 Sky Trak Rough Terrain Forklift (Lull).
The basket/platform was:
1) Not approved by manufacturer.
2) Missing Guardrail system and or Personal Fall Arrest System.
3) Employee left elevated while the Sky Trak was unattended.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD,
AMONG OTHER MEANS, IS TO FOLLOW THE GUIDANCE SET FORTH IN THE
SKY TRAK OPERATORS AND SAFETY MANUAL, WHICH PROHIBITS THE USE
OF A NON-APPROVED HOME MADE (JOB-MADE) WORK PLATFORM.
