Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing injuries from a forklift truck.
(a) Location - 32 Merrill Street, Amesbury, MA:
On or about 8/9/06, employees in the yard were observed operating a Nissan
Optimum
60 on unstable road surfaces without engaging the seatbelt as required in
ASME B56.1-
1993.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to train or re-train all forklift operators on the hazards and
requirements to use
seatbelts at all times; and to enforce the use of seatbelts while
operating forklifts.
