Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by vehicular traffic.
a)Construction site on Allie Dr., 0.3 miles south of Hackberry Ln.; On or
about 01/18/07,
the employer did not ensure that employees (spotters) directing heavy
equipment (dump
trucks) into specific positions, were wearing visible and reflective
vests/garments. This
exposed employees to being struck by backing vehicular traffic.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to:
1.Ensure that employees are wearing visible reflective vests/garments and
that the
vests/garments are worn as the outermost garment.
2.Develop and implement a traffic pattern which would provide for the
safety of
pedestrians in the area's where trucks are backing.
