North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fall hazards of
approximately 20 feet:
a)jobsite, ALDI store #11 - employee was exposed to a 20 foot fall hazard
while
being lifted on the forks of a HYSTER rough terrain forklift.
Among other methods, the employer could abate the hazard by utilizing an
approved personnel platform when employees must be elevated by a forklift.
