General-duty citation text
Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazards of falling from a man-lift basket, while the basket was elevated on the forks of a powered industrial truck: Consensus Standard ASME B56.1-2000, Safety Standards for Low Lift and High Lift Trucks, Paragraph 4.17.2(c): Whenever a truck is used to elevate personnel, the following precautions for the protection of personnel shall be taken - - "Be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyards, or deceleration devices, etc., are placed and properly used." On or about October 3, 2006, an employee was elevated up to approximately 10 feet in height in a man-lift basket on the forks of a powered industrial truck. The basket was not guarded with adequate railing, in that the access end of the basket did not contain a midrail. The employee did not use any other means of fall protection. Feasible Method of Correction a) Install a midrail on the access end of the basket. b) Use a safety harness with lanyard attached to the mast or basket DISCLAIMER: a) The employer is not limited to the abatement method(s) suggested by OSHA. b) The employer is responsible for selecting and implementing an effective abatement method. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
