Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm in that
employees were exposed
to the hazard of falling from an elevated location:
(a) IN THE WAREHOUSE, MAIN BUILDING -- A EGA PRODUCTS, INC. FABRICATED
METAL MANLIFT PLATFORM, WITH A LOAD CAPACITY LABEL OF 850 LBS., HAD
BEEN USED BY PERSONNEL TO SERVICE LIGHTING FIXTURES FROM THE FORKS
OF A PROPANE-POWERED FORKLIFT TRUCK AT THIS FACILITY. THE MANLIFT
WAS SECURED FROM A COMPANY THAT HAD GONE OUT OF BUSINESS IN THE
PAST YEAR.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to use a platform that meets the design requirements contained in American
National Standards
Institute Standard ANSI B56.1-2005 entitled "Safety Standard for Low Lift
and High Lift
Trucks".  In particular, comply with the following provisions of the ANSI
standard:
1.Obtain documentation from the manufacturer of the platform or have a
qualified engineer
evaluate the platform to ensure that chain guardrails are capable of
withstanding a concentrated
force of 890 newtons (200 pounds), (ANSI B56.1-2005 paragraph
7.37.1(d)(1)), and to ensure
that structural components of the platform have a structural safety factor
of not less than 3 to
1 (ANSI B56.1-2005 paragraph 7.37.1(g)).
2.Prominently mark the following information on the platform:  maximum
load of the
platform including personnel and equipment, weight of the empty platform,
and minimum
capacity of the fork truck on which the platform can be used (ANSI
B56.1-2005 paragraph
7.37.3(i).
(b) IN THE BOLLEGRAAF ROOM -- A FABRICATED MANLIFT PLATFORM WITH NO
IDENTIFIABLE NAME, HAD BEEN USED BY PERSONNEL TO ACCESS WIRE WHERE
IT IS DRAWN UP FROM WIRE STANDS TO A PULLEY ABOVE ON A LARGE
BOLLEGRAAF COMPACTOR AND PAPER BALER; THE MANLIFT PLATFORM WAS
IN POOR PHYSICAL CONDITION WITH A SEVERELY CRUSHED FENCE SECTION.
THERE WAS NO RATED CAPACITY PLATE ON THE BODY OF THIS MANLIFT.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to use a platform that meets the design requirements contained in American
National Standards
Institute Standard ANSI B56.1-2005 entitled "Safety Standard for Low Lift
and High Lift
Trucks". In particular, comply with the following provisions of the
standard:
1.Repair the damaged sections of the platform under the direction of a
qualified engineer.
After repairs have been completed, have the engineer evaluate the
integrity of the platform and
certify that structural components of the platform have a structural
safety factor of not less than
3 to 1 (ANSI B56.1-2005 paragraph 7.37.1(g)).
2.Prominently mark the following information on the platform:  maximum
load
of the
platform including personnel and equipment, weight of the empty platform,
and minimum
capacity of the fork truck on which the platform can be used (ANSI
B56.1-2005 paragraph
7.37.3(i).
