employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard being crushed or struck by the arm or the
bucket of the 3308
Crawler Excavator:
(a) Location - 210 Howe Street, Methuen, MA:
On or about 01/25/2007, an employee was struck by the arm or the bucket of
a
Caterpillar 345A Excavator.
Among other methods, feasible means of abatement include (1) Instruct
employees to stay
clear of the swing area when machine is operating as it states in the
Caterpillar Operation
Manual.
