Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by a pyrotechnic aerial shell:
On or about 05/28/07, employees working for Rhino Displays at the Quincy
Raceway were
exposed to the hazard of being struck by a pyrotechnic aerial shell when
they stapled quick
match fuse to the wooden mortar racks in violation of the Nation Fire
Protection Association
NFPA 1123, Code for Fireworks Display, 2006 Edition, Section 4.6.4  which
states "Staple
guns shall not be permitted to be used to secure quick match that is
connected to aerial shells,
mines, or comets."
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to secure the quick match with a rubber band wrapped around the mortar,
secure
the quick
match with duct tape, secure the quick match using string to tie it down,
or by a combination
of these methods.ion
