Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazards while working at elevations:
On or about September 10, 2007, Nu-Wave Car Wash Distributors, Inc. had an
employee
exposed to a 81 inch fall hazard, while working from the seventh step of a
Werner manufactured
fiberglass stepladder.  The manufacture of the stepladder, Werner, had
warning signs on the step
ladder prohibiting employees from working on or above the seventh step of
the stepladder.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to:
a)Follow and implement the manufacture's labeled requirements, "Do not
stand at
or above this level (seventh step). You can lose balance."
b)Ensure that employees do not step or stand on the top cap and the top
stop of a
step or trestle ladder as prescribed in Section 9.3.2 of American National
Standards
Institute (ANSI) A14.5-2007, American National Standard for Ladders -
Portable
Reinforced Plastic Safety Requirements.
