Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a)Back of retail store by storage shelves: A Louisville 12" wooden stepladder was being used to access storage shelves where the stepladder was leaning against the shelves, on or about 4/12/07. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to ensure that the stepladder is fully opened and properly set up prior to use as indicated by the American Standards Institute (ANSI) A14.1-90, 8.3.1.2 Safety Code for Wooden Ladders Requirements.
