P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck-by hazards:
a) On or about May 6, 2009, at The Island's construction site, an employee
was
exposed to struck-by hazard from riding on the tailgate of the company
truck.
Among other feasible means of abatement, an acceptable means of abatement
to correct
this hazard is to not allow employees to ride on the tailgate in
accordance with the
owner's manual.
ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED
