Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by, run over or crushed by the rear wheels of
the dump trucks.
Among other methods, one feasible and acceptable method to correct this
hazard is to follow
company safety rules as outlined which states when backing don't move
truck while backing into
paver until a signal hand or verbal.
a.On or about April 3, 2007, the 2007 Kenworth T-300 was back up to the
paver
with out a ground guide or other type of signal being provided to the
driver.d
