Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards created by crane and/or crane component failure due to lack of required semiannual inspection in accordance with requirements of the most applicable version of ASME and ANSI B30.2.0, Overhead and Gantry Cranes. Among other methods, one feasible and acceptable means of abatement is to establish and implement an inspection and preventative maintenance program based upon the manufacturer's recommendations and/or the recommendations in the American National Standards Institute's "Safety Code for Cranes Derricks, Hoists, Jacks and Slings". (a) Location - Establishment On or about 7/2/07, the employer had not performed a periodic inspection of the B.E. Wallace Magic Pole Universal Gantry crane.
