Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees
exposed to a
crushing/struck-by hazard while operating a forklift without wearing a
seat belt:
a) 600 16 th St., Carlstadt, NJ: Employees were not wearing seatbelts
while operating
Hyster and Nissan powered industrial trucks, on or about 01/28/2008.
Abatement Note: Among feasible and acceptable abatement methods to correct
this hazard is
to ensure the proper use of restraint system while operating forklifts as
referenced in the
Industrial Truck Standards Development Foundation (ITSDF) B56.1-2005
(Reaffirmation of
ASME B56.1-2004). On page 7 of the company forklift safe operating
procedures
states "Be
sure to buckle".
