5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to impact and puncture hazards caused by chipping off of the Enterprise hydraulic shear blade's cutting edges. Improperly adjusted blade clearance may cause accelerated blade heating and expansion or poor cutting and chipping of the blade's cutting edges. Feasible and acceptable abatement methods to correct this hazard include: A) Ensure the initial and continuing competence of inspection and maintenance personnel through proper training, as referenced in ANSI Z268.1-1982, Safety Requirements for Design, Use, and Maintenance of Metal Scrap Processing Equipment; and B) ensure the shear blades are properly installed and shimmed in accordance with the manufacturer's, The Enterprise Company, hydraulic shear, Shear Blade Maintenance & Installation manual.
