Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that
employees of
Cummins Rocky Mountain LLC and PAR Electrical Contractors, Inc were
exposed to the hazard
of being struck by flying parts/pieces as a base mounted drum hoist was
being tested by applying
tension to a polyester rope tied to a crane scale to measure tension:
(a) Establishment Site: On or about 04/21/08 an employee was fatally
struck by a crane scale
during tension testing operations when the 5/8" polyester rope failed as
he walked under the line.
Feasible and acceptable methods to correct this hazard are:
(1) Use a rope with a Safe Working Load/Maximum Working Load Rating with
the size, grade,
and construction able to withstand the load imposed.
(2) Have used the manufacturers recommended splice.
(3) Have the engineer who designed this Base Mounted Drum Hoist share the
design
information/load rating specifications with PAR Electrical Contractors,
Inc
so they can make a
Load Rating Tag and attach it to the Base Mounted Drum Hoist and train
their employees of its
limitations.
(4) Have the engineer who designed this Base Mounted Drum Hoist design a
brake system so
that the employees of PAR Electrical Contractors, Inc don't have to change
the hydraulic bypass
settings on the Base Mounted Drum Hoist to keep the Drum secured.
