Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from the elevated scissor lift by climbing over the railing onto the roof. a) An employee was exposed to a fall hazard of approximately 17 feet while climbing over the top railing of the JLG Model #26 MRT scissor lift to access the roof without fall protection. The employee was climbing over the parapet wall on the roof in order to provide another employee nails that he retrieved from below. Some feasible means of abatement include: 1) Comply with requirements of ANSI/SIA A92.6-1990 National Consensus Standard "Self-Propelled Elevating Work Platforms" that requires that manufacturer instructions be followed for entering/exiting lift platforms and for personnel to maintain a firm footing on the work platform. 2) Comply with JLG's operating manual which states on page "c" that employees shall always stand on the floor of the platform, not on boxes, planks, railing or other devices, for a work position. 3) Monitor employees' work practices to ensure compliance. 4) Establish and enforce a discipline policy.
