North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by: a) within the facility, and during delivery, the synthetic straps being used to secure the steel beams for transport were damaged. Reference: US Department of Transportation, Federal Motor Carrier Safety Administration, Cargo Securement Rules, Section 393.107, (b) Prohibition on the use of damaged securement devices. Among other methods, one feasible and acceptable method to abate this hazard is to provide adequate, undamaged straps for securing and transport of steel beams and inspect the straps on a daily basis prior to use.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by/caught in-between: a) within the facility, an employee was positioned between two pieces of steel while moving the steel beams with an overhead crane. Among other methods, one feasible and acceptable method to abate this hazard is to ensure employees are trained to stand at the end of the beams and not between beams during re-positioning and transporting.

Reference: The American Society of Mechanical Engineers, Safety Standard for Rough Terrain Forklift Trucks, ASME B56.6-2002, Part II, Section 5.15, Elevating Personnel. Reference: The American Society of Mechanical Engineers, Safety Standard For Rough Terrain Forklift Trucks, ASME B56.6-2002, Part III, Section 8.5, Nameplates and Markings. Among other methods, one feasible and acceptable method to abate this hazard is to provide a load rating capacity test of the personal lift platform and affix the maximum capacity to the attachment.
