North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were operating a chainsaw which was missing safety devices: a)residential street and yard - where the STIHL D34AV and the POULAN 2000 chainsaws did not have a chain retainer (catch) installed. Among other methods, one reasonable and feasible method of abatement is to repair or replace chainsaws when safety devices are damaged or missing. Reference: ANSI Z133.1-1994, Paragraph 7.2.1., "The manufacturer's operating and safety instructions should be followed unless modified by this standard." and; 29 CFR 1910.242(a), "Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. b)residential street and yard - where the STIHL D34AV and the POULAN 2000 chainsaws did not have a chain brake installed.
