Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that an
employee was exposed to a fall hazard associated with an overloaded
boom-supported
elevating work platform:
a) On or about October 25, 2007, at the above located workplace an
employee working in a
Genie S-65 boom-supported elevating work platform with (4) other workers
was exposed to
injuries from a forty (40) foot fall due to an overloaded work platform.
The platform was
designed for a maximum of two occupants. Among other methods, a feasible
and acceptable
method to control this hazard is to adhere to the safe design and
operation of the boom-
supported elevating work platforms as prescribed by Genie S-65 Operator's
Manual and by
American National Standards Institute Standard for Boom-Supported
