Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a)The employees were exposed to death, trapped, struck by and / or crushed by slabs of marble or granite. On October 26, 2010, an employee died and another was injured when a slab of marble and granite fell from the area where they were stored. The employees were in the process of moving slabs marble and or granite manually, which measure about 6 feet wide by 8 feet long and weights approximately 500 pounds. The slabs were tilted on a shelf that was fixed to the floor. When employees began to move or remove the slabs of marble from the shelf where they were stored the shelf broke, causing six marble slabs fell crushing an employee and strike the other employee on the body. Among other one feasible and acceptable method to correct this hazard are: 1.Design the shelves where the slabs are placed so that it can withstand the weight and strength of the slabs. 2.Design to store shelves marble slabs so that they can not shift, slide and collapse, and / or restraint to ensure that the tiles do not move, slide or collapse.
