Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards while standing on the midrail that was around a JLG, MS Series Sizzor Lift Self-Propelled Elevating Work Platform. The employees was working approximately 20 ft. above the ground. (a) Construction Site, Hwy 49, South, Hattiesburg, MS - On or about 1/18/08, employee was observed standing (working from) on the midrail of the JLG MS Series Scissor lift. Abatement Note: Among others, one reasonable and feasible method to reduce this hazard would be to instruct employees on prohibited practices set forth in the JLG Operators and Safety Manual and the Manual of Responsibilities for Dealers, Owners, Users, Operators, Lessors and Lessees of ANSI/SIA A92.6-1990, Self-Propelled Elevating Work Platforms, Personnel Footing. Personnel shall maintain a firm footing on the floor while working thereon.
