Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that:employees were exposed to fall hazard and or run over
hazards.
(a)Loading Dock - On or about, March 26, 2009, an employee was observed
operated the CAT forklift without the wearing of seat belt.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to follow the manufacture's guidelines in requiring all forklift operators
to wear seat belt when
operating the forklift.
(b)Warehouse - On or about March 26, 2009, an employee was operating a
Clark
forklift, model #EC500S30, serial #E235-0156-5041, which did not have a
seat
belt.
Among other methods, a feasible and acceptable method of correction is to
install a seat belt
retrofit package and require seat belt to be worn when the forklift is in
operation.
