Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling. a)362 Route 9 North: An employee fell from a pallet, which was mounted to the forks of a rough terrain fork lift (lull). This condition occurred on or about 2.2.08. FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD INCLUDE: 1.The employer should enforce work rules, which prohibit workers from using work platforms suspended by rough terrain forklifts that do not provide proper fall protection. 2.The employer should utilize other methods to allow employees to work at heights above 6 feet with proper fall protection. ANSI B56.6 Safety Standard for Rough Terrain Forklifts Paragraph 6.2.8 states "Do not permit passengers to ride on rough terrain forklift trucks unless a safe place to ride has been provided by the manufacturer." 3.The safety manual for the rough terrain forklift involved in this accident requires that "only equipment designed specifically to elevate personnel may be used for this purpose." NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
