Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling off the rear of a dump truck and being struck by the wheels and/or axle. On 22 May 2008, employees were observed utilizing a dump truck to spread water as part of the process of building a parking lot surface. An employee had been directed to sit on the rear of a dump truck that was traveling in reverse. The employee was sitting on an eleven inch by twenty four inch seat that was located directly over/in front of the rear/dual wheels when the truck was traveling in reverse. The exployee was exposed to the hazard of being run over and crushed by the vehicle. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that personnel are not transported on/in the rear of a vehicle that is not intended for passengers.
