Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crushing hazard since seat belts were not worn
while operating
a powered industrial truck:
(A)Job Site: On November 28, 2007, and at times prior thereto, an employee
operating a Pettibone rough terrain forklift, model C8000, serial number
7-036
did not wear the provided seat belt.
ABATEMENT NOTE: Amongst other methods, one feasible and acceptable method
of
abatement to correct this hazard is to require the use of seatbelts when
operating forklifts
(powered industrial trucks) as required by American National Standard
Institute/American
Society of Mechanical Engineers (ANSI/ASME) B56.1.
Note: Abatement certification is required for this item..
