Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to dust explosion, deflagration, or other fire hazards because methods were not utilized to ensure proper collection of and prevent ignition of combustible aluminum dusts during the generation, handling, and collection operations: a) Castek Aluminum, Inc. - Elyria, Ohio: On or about February 28, 2009 the employer failed to ensure that hoods or capture devices were provided and used in the Cleaning Department to collect aluminum dust generated from the grinding, polishing and finishing of aluminum castings. The accumulation of aluminum dust in the Cleaning Department created explosion hazards for employees working in the area. Abatement Note: Among other methods, a feasible abatement method to correct this hazard is to design and install appropriate dust collection systems to prevent the accumulation of aluminum dust on surfaces in the Cleaning Department. The desgin and installation of the dust collection system must comply with appropriate NFPA standards and recognized and generally accepted good engineering practices. Reference the National Fire Protection Association (NFPA) 484 Standard for Combustible Metals, Section 6.3.2.1. Abatement Schedule Step 1A written detailed plan of abatement shall be submitted to the Area Director outlining a schedule for the implementation of engineering, instrumentation, and equipment to protect employees from fire and deflagration hazards related to combustible dust as referenced in this citation. This plan shall include, at a minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation: 1.Evaluation of engineering control options; 2.Selection of optimum control methods and completion of design; and 3.Procurement, installation and operation of selected control measures. All proposed control measures shall be approved for each particular use by a person competent in fire and deflagration control of combustible dusts. At the conclusion of the 60-day period, the detailed plan for abatement shall be submitted to the Area Director. Step 2Abatement shall be completed by the implementation of feasible engineering controls upon verification of their effectiveness in achieving compliance.
