Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushing injuries in the event of an equipment
rollover and the
provided seat belt was not in use:
(a)White Oak Development.  The provided seat belt was not worn by the
operator of the
Caterpillar D8N dozer, S/N 5T100965, on or about May 14,2008.
Among other methods, one feasible and acceptable abatement method to
correct his hazard is
to enforce the use of seat belts when equipment is provided with rollover
protection.
