Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to cut and abrasion hazards:
(a) On the east side of the building under construction: Employees
constructing
concrete curb forms were exposed to uncapped 1/2 inch and 3/4 inch forming
pins that were approximately 24 inches in height above ground level.
Among other methods, one feasible and acceptable method to correct this
hazard is: Install
caps over forming pins or install forming pins to level of form.
