Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falls:
a)On or about February 20, 2008, the employer did not ensure that
employees were
protected from the hazard of falls in excess of 14 feet while working on a
work platform
supported by a Terex Handlers Forklift, Model TH644C.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to have the scaffold designed by a qualified person utilizing the
requirements of ANSI/ASME
B56.6 and/or to comply with the manufacturer's equipment operating
guidelines in order to
protect employees from exposure to falls.re
