Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while being lifted on the forks of powered industrial trucks. a) Joshen Paper Company, warehouse - On or about 11/9/09, employees were potentially exposed to a fall hazard of at least 10-feet when they were lifted on the forks of the powered industrial trucks in order to access the storage racks. Employees were not protected from falls by any fall protection systems, devices, and/or platforms. ABATEMENT NOTE: One feasible and acceptable method of abatement would be to elevate personnel on a safety platform, attached to the forks, which was approved by the manufacturer in accordance with ANSI B56.1-2005 Section 7.37, Safety Standard for Low Lift and High Lift Trucks. These platforms must also be physically secured to the forklift.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to damaged rack storage components that were not inspected, and subsequently repaired and replaced: A.) Joshen Paper Company, warehouse - On or about 11/9/09, employees were potentially exposed to struck-by hazards from damaged storage racks that had not been inspected. A storage rack inspection program was not developed and implemented as evidenced by: 1.) Pronounced bowing of a rack that was rated for 3,325 lbs. 2.) Damage to the rack's legs and crossing bracing. ABATEMENT NOTE: Among other methods, feasible and acceptable means to correct these conditions include: 1. Complying with ANSI MH16.1, 2008 paragraph 1.4.1: "the owner shall maintain the structural integrity of the installed rack system by assuring proper operational, housekeeping, and maintenance procedures including but not limited to the following: 2. Regularly inspect for damage. If damage is found, immediately unload the affected area and replace or repair any damaged columns, beams, or other structural components. 3. The employer should conduct a one hundred percent inspection of racks located in their warehouse in order to identify and repair/replace all of the damaged racks.d
